F-1 to H-1B as a nurse, realistically
The standard advice on this transition was written for software engineers. Almost none of it survives contact with a nursing timeline.
The lottery, in numbers
Cap registration happens once a year, usually in early March, for jobs starting the following October. Since February 2026 selection is weighted by Department of Labor wage level: four entries at Level IV, three at Level III, two at Level II, one at Level I. Staff nursing roles price at Level I, where DHS projected a 15.3% selection rate when it wrote the rule.
A STEM graduate with 36 months of OPT can enter three times. You can enter once.
Cap-gap, and why it matters less than you think
If you are selected and your employer files a cap-subject petition while your OPT is valid, cap-gap extends your work authorization through September 30, bridging you to the October 1 start. That is genuinely useful.
It only helps if you are selected. At roughly one attempt in six, cap-gap is a contingency, and you still need a plan.
The route that does not involve a lottery
A cap-exempt employer files outside the annual cap, at any time of year. No March window, no October start, no lottery. For someone with twelve months of work authorization that is the difference between a plan and a hope.
The two fee measures, and the difference between them
These get discussed as though they were the same thing. They are not, and the distinction decides whether either one touches you.
Proclamation 10973 imposed a $100,000 payment on certain new petitions. Read the status carefully, because most summaries get it wrong in one direction or the other.
In June 2026 a federal court in Massachusetts vacated the agency policy implementing the proclamation. It did not strike down the proclamation itself, which formally remains on the books. In July the First Circuit refused the government’s request to put that ruling on hold while it appeals, so the vacatur stands for now. The payment is not being collected. The appeal is still live, with briefing running into late October 2026.
Separately, the proclamation expires by its own terms in late September 2026. Its text says 12:01 a.m. on September 21; a lot of commentary says September 20. Either way it is days away as we write, and we have seen no extension or replacement.
It also never applied to someone changing status inside the United States.
The proposed $103,265 fee was published on August 25, 2026. Read the scope carefully, because this is where most summaries go wrong:
- It would apply only to cap-subject petitions, the ones that go through the annual lottery, including advanced degree cases.
- Cap-exempt petitions are excluded. If your employer is a university, an affiliated nonprofit, or a qualifying research organization, the proposed fee does not reach the petition filed for you.
- Extensions, amendments and transfers for someone already counted against the cap are also excluded.
- Unlike the $100,000 measure, it has no exemption for a change of status filed inside the United States.
- It would sit on top of any proclamation payment rather than replacing it.
Nothing is payable unless a final rule issues, and the comment period closes September 24, 2026. Anyone can comment at regulations.gov under docket USCIS-2026-0298.
Worth knowing how employers reacted to the first one. In an American Hospital Association survey published in April 2026, 64% of hospitals that used or planned to use the H-1B program said they would pause, defer or limit recruitment because of the $100,000 fee. That fee is not being collected. The reaction tells you how quickly sponsorship appetite moves when cost changes, which is the risk the proposed fee reintroduces for cap-subject employers.
The point to carry away: the old measure would not have reached you because of where you were standing. The new one, if finalized as written, would. What keeps you outside it is your employer being cap-exempt.
